This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. Details of the form, colour and finish of the materials to be used externally on the walls and roofs shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.

    Reason - To ensure that the development is visually satisfactory.

  3. The building hereby permitted shall be used only for the storage of hay, machinery and equipment, and as a mess room, office and toilets, in connection with the use of the adjacent land for agricultural purposes and the adjacent fishing pools and stock pools and for no other purpose whatsoever.

    Reason - To define the permission and preserve the amenities of the locality.

  4. The permission hereby granted shall be implemented only in lieu of and not in addition to permission granted under application W/02/01807 dated 6th February 2003.

    Reason - In order to prevent an over-development of the site.

  5. Details of tree planting adjacent to the building hereby approved shall be submitted to and approved in writing by the Local Planning Authority, before the building is first erected. The approved planting shall be carried out within the first planting season following the commencement of the use of the building or at such later date as may be agreed in writing by the Local Planning Authority.

    Reason - To ensure that the development is visually satisfactory.

  6. All approved tree planting shall be maintained for a period of five years commencing at the completion of the final phase of implementation. Any tree that is removed, uprooted or destroyed or dies or, in the opinion of the Local Planning Authority, becomes seriously damaged or defective, shall be replaced in the same position with another of the same species and size as that originally planted.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  7. The existing caravan on the site shall be removed following the erection of the building hereby permitted.

    Reason - In order to prevent an over-development of the site and improve the visual amenities of the area.

  8. There shall be no storage of any materials, including soil, within that part of the site liable to flood.

    Reason - To ensure that there will be no increased risk of flooding to other land/properties due to impedance of flood flows and/or reduction of flood storage capacity.

  9. There shall be no new buildings, structures (including gates, walls and fences) or raised ground levels within the 1 in 100 year flood plain of the River Salwarpe.

    Reason - This area acts to preserve access to the watercourse and as a buffer to protect the watercourse from the effects of development. It will ensure that no impedance of flood flows and/or reduction of flood storage capacity takes place.

  10. There shall be no discharge of foul or contaminated drainage from the site into either groundwater or any surface waters, whether direct or via soakaways.

    Reason - To prevent pollution of the water environment.
