This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. The permission shall relate to the originally submitted plan(s) and to the amended plans received on 11/11/03.

    Reason - To define the permission.

  3. Precise details of the materials to be used in the construction of the bund shall be submitted to and subject to the approval in writing of the Local Planning Authority before any work on the site commences. All materials to be inert and non-contaminated, and natural.

    Reason - To ensure that suitable materials are used for the proposed bund and to prevent pollution of the water environment.

  4. The hours of work for all contractors for the duration of the site development shall be limited to:-

    8.00 am to 6.00 pm Mondays to Fridays 8.00 am to 12.00 noon Saturdays

    and no work shall be carried out on Sundays or Bank Holidays.

    Reason - In the interests of the amenities of neighbouring occupiers.

  5. Development shall not begin until wheel cleaning apparatus has been provided on the development site in accordance with details which have been submitted to and approved in writing by the Local Planning Authority. The wheel cleaning apparatus approved by the Local Planning Authority shall be provided, operated and maintained from a position within the site to ensure that wheels of vehicles are cleaned before entering any road accessible to the general public for the duration of the construction work.

    Reason - To ensure that the wheels of vehicles are cleaned before leaving the site onto roads accessible to the general public in the interests of highway safety.

  6. Access for all vehicles for the site development shall be via the existing premises at S E Davis and Son.

    Reason - To define the permission and in the interest of road safety.

  7. All approved tree and shrub planting as indicated on Smiths Ltd drawing no. 2615-09, dated 8/11/2003 shall be planted over the whole of the area indicated at 1.5 metres centres. Planting to be completed within the first planting season following substantial completion of the earth works.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  8. All approved hard and soft landscaping and tree planting shall be maintained for a period of five years commencing at the completion of the final phase of implementation in accordance with the approved schedule. Any tree or other plant that is removed, uprooted or destroyed or dies or, in the opinion of the Local Planning Authority, becomes seriously damaged or defective, shall be replaced in the same position with another of the same species and size as that originally planted.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  9. All existing trees and hedges on site, or branches from trees on adjacent land that overhang the site, unless indicated on the approved plan(s) to be removed, shall be retained and shall not be felled or pruned or otherwise removed within a period of five years from the completion of the development without the previous written consent of the Local Planning Authority.

    Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality.
