This decision is subject to the following conditions:
The development hereby permitted shall be begun before the expiration of five years from the date of this permission.
Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.
The permission shall relate to the originally submitted plan(s) and to the amended plans received on 3 November 2003 and 9 January 2004.
Reason - To define the permission.
Details of the form, colour and finish of the materials to be used externally on the walls and roofs shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.
Reason - To ensure that the development is visually satisfactory.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, nothing in Article 3 and Schedule 2 to that order shall operate so as to permit any development specified in Part 1, Classes A-D of the said schedule and no such development shall be carried out at any time without an express grant of planning permission under Part III of the Town and Country Planning Act 1990.
Reason - In order that the Local Planning Authority can gain control over the development and preserve the amenities of the adjoining properties.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, no additional windows or doors shall be inserted in side elevations of the dwellings hereby permitted.
Reason - To preserve the amenities of the occupiers of the adjacent dwellings.
All existing trees and hedges on site unless otherwise indicated on the approved plan to be removed, shall be retained and shall not be felled, topped or lopped or otherwise removed without the previous written consent of the Local Planning Authority.
Reason - To preserve the amenities of the locality.
No development shall take place until full details of both hard and soft landscape works have been submitted to and approved by the Local Planning Authority. These details shall include the following:-
1. means of enclosure within the development site;
2. treatment of the development site boundaries (including position, design, materials and type of boundary treatment);
3. planting plans, including tree, hedge, shrub and grassed area planting and a written specification (including cultivation and other operations associated with plant and grass establishment);
4. a schedule of plants noting species, plant sizes and proposed numbers and densities;
5. a programme of implementation;
6. a schedule of maintenance for a period of five years commencing at the completion of the final phase of implementation, the schedule to make provision for the replacement, in the same position, of any plant that is removed, uprooted or destroyed or dies or, in the opinion of the Local Planning Authority, becomes seriously damaged or defective, with another of the same species and size as that originally planted.
The works shall be carried out in accordance with the approved details, the programme of implementation and the schedule of maintenance.
Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.
The boundary details between the existing and proposed dwellings, agreed as part of Condition Number 7 above, shall be implemented before commencement of the erection of the new dwellings, and the proposed planting on this boundary shall be carried out within the first planting season following the commencement of the development, or at a date to be agreed in writing with the Local Planning Authority.
Reason - In order to preserve the amenities of the occupiers of the existing adjoining dwellings.
The dwellings hereby permitted shall be constructed at levels no higher than those indicated on the submitted plans.
Reason - In order to preserve the amenities of the area and the occupiers of the existing adjacent dwellings.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.
Reason - To preserve the amenities of the locality.
The erection of the dwellings hereby approved shall not begin until drainage works for the disposal of both surface water and foul drainage have been carried out in accordance with details to be submitted to and approved in writing by the Local Planning Authority.
Reason - To ensure a satisfactory means of drainage is available to serve the development.
There is a public sewer which crosses the site. No buildings shall be erected or trees planted within 2.5 metres of this sewer.
Reason - In order to maintain essential access for maintenance, repair, renewal and to protect the structural integrity of the public sewerage system.
Development shall not begin until parking for site operatives and visitors has been provided within the application site in accordance with details to be submitted to and approved by the Local Planning Authority and such provision shall be retained and kept available during construction of the development.
Reason - To prevent indiscriminate parking in the interests of highway safety.
The development hereby permitted shall not be brought into use until the access, turning area and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.
Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
Prior to the occupation of the development hereby approved, the driveway and/or vehicular turning area shall be consolidated, surfaced and drained in accordance with details to be submitted to and approved in writing by the Local Planning Authority at a gradient not steeper than 1 in 8.
Reason - In the interests of highway safety.
Before any other works hereby approved are commenced, the construction of the altered vehicular access onti the public highway shall be carried out in accordance with a specification to be submitted to and approved in writing by the Local Planning Authority, at a gradient not steeper than 1 in 12.
Reason - In the interests of highway safety.
Details of the means of interception and disposal of surface water drainage from the proposed new access driveway shall be submitted to and approved in writing by the Local Planning Authority, before development is commenced on site.
Reason: To ensure that satisfactory drainage arrangements are available and in the interests of highway safety.
