This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. Samples of the external facing bricks and roof materials shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.

    Reason - To ensure that the development is visually satisfactory.

  3. The hereby approved development shall be carried out in accordance with the details shown on the revised drawing No.15 received on 22nd August 2002.

    Reason - To define the permission for the avoidance of doubt.

  4. The development hereby permitted shall not be brought into use until the access, turning area and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.

    Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.

  5. Development shall not begin until parking for site operatives and visitors has been provided within the application site in accordance with details to be submitted to and approved by the Local Planning Authority and such provision shall be retained and kept available during construction of the development.

    Reason - To prevent indiscriminate parking in the interests of highway safety.

  6. Details of foul and surface water drainage for the site shall be submitted to and approved in writing by the Local Planning Authority before any work on the site commences. The drainage works shall be constructed in accordance with the approved details before the dwelling is first occupied.

    Reason - To ensure that a satisfactory means of drainage is available to serve the development.

  7. No development shall take place within the area indicated (this would be the area of archaeological interest) until the applicants, or their agents or successors in title, has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted by the applicant and approved in writing by the Local Planning Authority.

    Reason - To protect archaeological interest on the site.

  8. No development shall take place until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of development and arrangements to be made for the permanent maintenance of the landscaped areas.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town & Country Planning Act 1990.

  9. All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the building or the completion of the development whichever is the sooner; and any trees or plants which may within a period of five years from the completion of the development die are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town & Country Planning Act 1990.

  10. None of the trees shown for retention on the approved drawing shall be topped, lopped, felled or have their roots cut without the prior written consent of the Local Planning Authority.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town & Country Planning Act 1990.

  11. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order revoking and re-enacting that Order, no development permitted by Classes A, B, C or E of Part I of Schedule 2 of the Order shall be carried out without the prior written permission of the Local Planning Authority.

    Reason - The site straddles the defined development boundary for Sedgeberrow and lies in close proximity to a Grade II listed building. This condition is necessary to prevent further encroachment into the countryside in the interests of visual amenity and of protecting the setting of the listed building.

  12. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order revoking and re-enacting that Order, there shall be no windows or other openings formed in the side elevation of the dwelling facing Lytton House.

    Reason - In the interest of preserving the residential amenities of adjoining occupiers.
