This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. The permission shall relate to the amended location plan dated 02/10/03 and site plan and cross sections dated 27/08/03.

    Reason - To define the permission.

  3. All excavated material resulting from the development hereby approved shall be spread on the land to the north of Mill Lane, as indicated on the amended location plan received on the 2nd October 2003, at a depth no more than 500mm and at a level no lower than 19.00 metres AOD(N).

    Reason - To ensure that there will be no increased risk of flooding to other land/properties due to impedance of flood flows and/or reduction of flood storage capacity.

  4. There shall be no storage of any materials including soil within that part of the site liable to flood.

    Reason - To ensure that there will be no increased risk of flooding to other land/properties due to impedance of flood flows and /or reduction of flood storage capacity.

  5. No development approved by this permission shall be commenced until a working method statement, for minimising pollution impact, has been approved by the Local Planning Authority. The construction shall be implemented in accordance with the approved details.

    Reason - To prevent pollution of the water environment.

  6. No development approved by this permission shall be commenced until a scheme for the provision of foul drainage works has been approved by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details.

    Reason - To prevent pollution of the water environment.

  7. Any facilities for the storage of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The volume of the bunded compound shall be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankage, the compound shall be at least equivalent to the capacity of the largest tank, vessel or the combined capacity of interconnected tanks or vessels plus 10&. All filling points, associated pipework, vents, gauges and sight glasses must be located within the bund or have separate secondary containment. The drainage system of the bund shall be sealed with no discharge to any watercourse, land or underground strata. Associated pipework shall be located above ground and protected from accident damage. all filling points and tank/vessels overflow pipe outlets shall be detailed to discharge downwards into the bund. Please note that any oil storage facility must comply with the Oil Storage Regulations 2000.

    Reason - To prevent pollution oft he water environment.

  8. Notwithstanding the details shown on the approved plans, prior to the commencement of the development hereby permitted, full details of the marina construction and design shall be submitted to and approved in writing by the Local Planning Authority. The work shall be carried out in accordance with the approved details.

    Reason - To ensure the protection and enhancement of the water environment and dependant fauna and flora.

  9. No boats shall be brought to or removed from the site by road.

    Reason: In the interests of highway safety.

  10. The development hereby permitted shall not be brought into use until areas for the manoeuvring, parking, loading and unloading of vehicles have been laid out, consolidated, surfaced and drained in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.

    Reason: To minimise the likelihood of indiscriminate parking in the interests of highway safety.

  11. Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.

    Reason - To preserve the amenities of the locality.
