This decision is subject to the following conditions:
The development hereby permitted shall be begun before the expiration of five years from the date of this permission.
Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.
There shall be no open storage of materials or equipment on the site. Any waste materials shall be kept in suitable containers and in positions on the site all as agreed, in writing, by the Local Planning Authority. These details shall be submitted and approved before the development hereby permitted is first commenced.
Reason - To preserve the amenities of the locality.
The underside of any opening window shall be at least 2.4 metres above the level of the adjoining public highway unless it is a window made to open inwards only or of the sliding type.
Reason - In the interests of highway safety.
The extracation equipment installed shall be regularly maintained to ensure its continued satisfactory operation. The cooking process shall stop if at any time the extraction equipment ceased to function to the satisfaction of the Local Planning Authority.
Reason - To preserve the amenities of the locality.
The use of the premises hereby approved shall not be operative between the hours of 23.00 to 08.00 Monday to Thursday, 23.30 to 08.00 Friday to Saturday and 23.00 to 09.00 on Sundays and Bank Holidays.
Reason - To improve the amenities of the locality.
Notwithstanding the detailed plans submitted 3.11.03 the development shall not start until further detailed drawings showing flues and ventilation openings together with a fume extraction system have been approved in writing by the Local Planning Authority. The flues and the ventilation fume extraction system shall be constructed in accordance with the approved drawings before the development is brought into use.
Reason - To ensure that any concentration of air pollutants in the vicinity is minimised and/or a nuisance is not caused.
