Decision: Approved - Change of Use

This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. The permission shall relate to the originally submitted plan(s) and to the amended site plan received on 4th December 2003.

    Reason - To define the permission.

  3. The materials to be used in the construction of the external surfaces of the new vehicular access hereby permitted shall match those used in the existing building.

    Reason - To ensure that the proposed works are executed in materials which harmonise satisfactorily with the existing building.

  4. Before any other works hereby approved are commenced, visibility splays shall be provided in accordance with the detail indicated on the deposited plan, number HD/284/01/A. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.

    Reason - In the interests of highway safety.

  5. The development hereby permitted shall not be brought into use until the access, driveways and turning areas shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

    Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.

  6. Prior to the use of the new access hereby approved, the existing vehicular access onto the adjoining highway shall be permanently closed. Details of the means of closure and reinstatement of the existing access shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of work on the development hereby approved.

    Reason - To ensure the safe and free flow of traffic using the adjoining highway.

  7. Development shall not begin until parking for site operatives and visitors has been provided within the application site in accordance with details to be submitted to and approved by the Local Planning Authority and such provision shall be retained and kept available during construction of the development.

    Reason - To prevent indiscriminate parking in the interests of highway safety.

  8. All existing trees and hedges on site unless otherwise indicated on the approved plan to be removed, shall be retained and shall not be felled, topped or lopped or otherwise removed without the previous written consent of the Local Planning Authority.

    Reason - To preserve the amenities of the locality.

  9. All approved tree and hedge planting shall be carried out in accordance with the programme approved by the local planning authority as part of the scheme.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  10. All approved tree and hedge planting shall be maintained for a period of five years commencing at the completion of the final phase of implementation in accordance with the approved schedule. Any tree or other plant that is removed, uprooted or destroyed or dies or, in the opinion of the Local Planning Authority, becomes seriously damaged or defective, shall be replaced in the same position with another of the same species and size as that originally planted.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.
