This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. The permission shall relate to the originally submitted plans and to the amended floor plans and elevations, planting plan and landscape proposal received on 9th December 2003.

    Reason - To define the permission.

  3. Samples of the external facing bricks and roof materials to be used in the construction of the external surfaces of the dwelling and gazebo hereby permitted shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.

    Reason - To ensure that the development is visually satisfactory.

  4. The development hereby permitted shall not be brought into use until the access, turning area and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.

    Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.

  5. No development shall take place which obstructs the existing public right of way crossing the application site until an Order has been made for it to be diverted or stopped up.

    Reason - To ensure the public right of way is not obstructed.

  6. Prior to any building works being first commenced, detailed drawings of the proposed window(s) showing design, sections through glazing bars and/or mullions, method of opening, finish and depth of external reveal, shall be submitted to and approved in writing by the Local Planning Authority.

    Reason - To ensure the historic and architectural character and appearance of the conservation area is properly preserved or enhanced, in accordance with Policies CB3 and CB4 of the Adopted Wychavon District Local Plan (January 1998) and Policy ENV13 of the Wychavon District Local Plan Review Second Deposit (July 2003).

  7. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, nothing in Article 3 and Schedule 2 to that order shall operate so as to permit any development specified in Part 1, Classes A - E inclusive and Part 2 Classes A & C of the said schedule and no such development shall be carried out at any time without an express grant of planning permission under Part III of the Town and Country Planning Act 1990.

    Reason - In order that the Local Planning Authority can gain control over the development and preserve the amenities of the adjoining properties.

  8. The precise position of the klargester bio disc and soakaway system shall be agreed on site and approved in writing by the Local Planning Authority, prior to any building works on site being first commenced.

    Reason - To ensure that the development would not cause harm to existing trees on site.

  9. All existing trees and hedges on site unless otherwise indicated on the approved plan to be removed, shall be retained and shall not be felled, topped or lopped or otherwise removed without the previous written consent of the Local Planning Authority.

    Reason - To preserve the amenities of the locality.

  10. All approved hard and soft landscaping works and tree planting shall be carried out in accordance with the programme approved by the local planning authority as part of the scheme.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  11. All approved hard and soft landscaping and tree planting shall be maintained for a period of five years commencing at the completion of the final phase of implementation in accordance with the approved schedule. Any tree or other plant that is removed, uprooted or destroyed or dies or, in the opinion of the Local Planning Authority, becomes seriously damaged or defective, shall be replaced in the same position with another of the same species and size as that originally planted.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  12. In this condition "retained tree" means an existing tree which is to be retained in accordance with the approved plans and particulars and paragraphs 1. and 2. below shall have effect until the expiration of one year from the date of the completion of the development.

    1. No retained tree shall be cut down, uprooted or destroyed, nor shall any retained tree be topped or lopped other than in accordance with the approved plans and particulars, without the written approval of the Local Planning Authority. Any topping or lopping approved shall be carried out in accordance with British Standard in force at the time of the work.

    2. If any retained tree is removed, uprooted or destroyed or dies, another tree shall be planted at the same place and that tree shall be of such size and species, and shall be planted at such time, as may be specified in writing by the Local Planning Authority.

    3. The erection of fencing for the protection of any retained tree shall be undertaken in accordance with the approved plans and particulars before any equipment, machinery or materials are brought on to the site for the purposes of the development, and shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made, without the written consent of the Local Planning Authority.

    4. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree.

    The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  13. The garage hereby approved shall only be used for the domestic storage purposes incidental to the domestic use of the dwelling and shall not be used for commercial or business purposes or converted into habitable accommodation.

    Reason - In order to prevent the overdevelopment of the site and to protect the amenities of the area.
