This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of five years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990.

  2. The permission shall relate to the originally submitted plan(s) and to the amended plans received on 8th December 2003.

    Reason - To define the permission.

  3. Details of the form, colour and finish of the materials to be used externally on the walls and roofs shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.

    Reason - To ensure that the development is visually satisfactory.

  4. Details of the surface materials of roads, paths, parking areas and other hard surfaces, shall be submitted to and approved by the Local Planning Authority before development commences.

    Reason - In order to ensure that the overall appearance of the development is satisfactory.

  5. The development hereby permitted shall not be brought into use until the access, turning area and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.

    Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.

  6. Before any other works hereby approved are commenced, visibility splays shall be provided from a point 0.6 metres above ground level at the centre of the access to the application site and 2 metres back from the nearside edge of the adjoining carriageway, (measured perpendicularly), for a distance of 90 metres in each direction along the nearside edge of the adjoining carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.

    Reason - In the interests of highway safety.

  7. Before any other works hereby approved are commenced, the construction of the vehicular access shall be carried out in accordance with a specification to be submitted to and approved in writing by the Local Planning Authority, at a gradient not steeper than 1 in 12.

  8. Prior to the occupation of the development hereby approved, the driveway and/or vehicular turning area shall be consolidated, surfaced and drained in accordance with details to be submitted to and approved in writing by the Local Planning Authority at a gradient not steeper than 1 in 8.

    Reason - In the interests of highway safety.

  9. The precise floorslab levels of the new dwelling, relative to the existing development on the boundary of the site shall be submitted to and approved by the Local Planning Authority prior to the commencement of the development.

    Reason - In order to ensure that the overall appearance of the development is satisfactory.

  10. No development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a plan indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed before the use hereby permitted is commenced or before the dwelling is occupied. Development shall be carried out in accordance with the approved details.

    Reason - In order to ensure that there is an acceptable form of screening with the adjacent property.

  11. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, nothing in Article 3 and Schedule 2 to that order shall operate so as to permit any development specified in Classes A to E inclusive of the said schedule and no such development shall be carried out at any time without an express grant of planning permission under Part III of the Town and Country Planning Act 1990.

    Reason - In order that the Local Planning Authority can gain control over the development and preserve the amenities of the adjoining properties.

  12. Nothwithstanding the details with regard to foul drainage as shown on the accompanying planning application forms, the development hereby permitted shall not commence until drainage works for the disposal of both surface water and foul sewage have been carried out in accordance with the details to be submitted to and approved by the Local Planning Authority in writing.

    Reason - There are no public foul/surface water sewers available within the vicinity of the site to serve this development, and to ensure that the development is provided with a satisfactory means of drainage, and to reduce the risk of creating or exacerbating the flooding problem.

  13. No development shall take place until details of all tree planting have been submitted to and approved in writing by the Local Planning Authority. The details shall include the following:-

    1. a schedule of trees noting species, plant sizes and proposed numbers and densities;

    2. a programme of implementation;

    3. a schedule of maintenance for a period of five years commencing at the completion of the final phase of implementation, the schedule to make provision for the replacement, in the same position, of any tree that is removed, uprooted or destroyed or dies or, in the opinion of the Local Planning Authority, becomes seriously damaged or defective, with another of the same species and size as that originally planted.

    The tree planting shall be carried out in accordance with the approved details, the programme of implementation and the schedule of maintenance.

    Reason - The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and to discharge its duty under S197 of the Town and Country Planning Act 1990.

  14. The garage hereby approved shall only be used for the domestic storage purposes incidental to the domestic use of the dwelling and shall not be used for commercial or business purposes or converted into habitable accommodation.

    Reason - In order to prevent the overdevelopment of the site and to protect the amenities of the area.

  15. Development shall not begin until parking for site operatives and visitors has been provided within the application site in accordance with details to be submitted to and approved by the Local Planning Authority and such provision shall be retained and kept available during construction of the development.

    Reason - To prevent indiscriminate parking in the interests of highway safety.
