This decision is subject to the following conditions:
The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Before the change of use hereby approved is first implemented, a scheme of sound attenuation between the ground floor use hereby approved and first floor residential property shall be submitted to and approved in writing to the Local Planning Authority. The approved details should then be implemented prior to the use hereby approved being first commenced.
Reason - In order to ensure the proposed use does not have a detrimental impact on the private amenity of the first floor residential flat in accordance with Local Plan Policy GD2
Notwithstanding the detail specified within the application form, the opening times proposed for the unit shall be agreed in writing with the Local Planning Authority prior to the use hereby approved commencing. The A3 use hereby approved shall only operate during the approved hours of opening.
Reason - In order to ensure the proposed use does not have a detrimental impact on the private amenity of the first floor residential flat in accordance with Local Plan Policy GD2
Notwithstanding any information submitted with the planning application, the permission hereby approved does not authorise the use of the rear garden area of the property for A3 use.
Reason - To define the permission and ensure the private residential amenity of the first floor flat is preserved in accordance with Local Plan Policy GD2
