Decision: Approved - Outline

This decision is subject to the following conditions:

  1. Application for approval of reserved matters shall be made to the Local Planning Authority before the expiration of three years from the date of planning permission ref. no. W/10/00295 (therefore by 3rd August 2014). The development hereby permitted shall be begun before the expiration of two years from the date of approval of the last of the reserved matters to be approved.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004

  2. Approval of the details of the appearance, landscaping, layout and scale of the development hereby approved (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority in writing before any development is commenced.

    Reason - This permission is in outline only and further details of the reserved matters are required to ensure satisfactory development.

  3. The renewable energy measures, measures to conserve and recycle water, energy efficiency measures and details of construction materials to be used in the proposed development as submitted and approved under the provisions of condition 5 attached to planning permission ref. no. W/10/00295 shall be incorporated into the development hereby permitted in accordance with the implementation timetable also required and approved by condition 5.

    Reason - To ensure the prudent use of natural resources.

  4. Within one month of the date of this permission,a Construction Environmental Management Plan shall be submitted to the Local Planning Authority for approval in writing. This shall include the following:- a. Measures to protect the amenities of nearby properties from noise, vibration and dust production during the construction of the development hereby approved; and b. Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc). c. details of wheel washing equipment to be provided on the site.

    The measures set out in the approved Plan shall be carried out in full during the construction of the development hereby approved. Site operatives parking, material storage and the positioning of operatives facilities shall only take place on the site in locations approved by in writing by the Local Planning Authority.

    Reason - To protect the amenities of nearby properties during the construction of the development and to protect the water environment from pollution.

  5. Any reserved matters application relating to the appearance, scale and layout of the development shall include a statement providing an explanation as to how the design of the development has had regard to the Design and Access Statement submitted with this planning application. Details to be submitted shall include full details of materials to be used in the construction of the external appearance of any building.

    Reason - In the interests of visual amenity.

  6. In relation to the requirements of conditions 1 and 2, details of the facilities for the storage of refuse for all proposed buildings within the development shall be submitted as part of any reserved matters application(s). No individual dwelling shall be occupied until approved refuse storage facilities to serve that dwelling have been constructed in accordance with approved details.

    Reason - To ensure the proposed dwellings have adequate refuse storage facilities.

  7. Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.

    Reason - To preserve the amenities of the locality.

  8. A surface water drainage scheme shall be implemented in accordance with the details submitted and approved under the provisions of condition 11 attached to planning permission ref. no. W/10/00295 prior to the occupation of the first dwelling hereby approved or in accordance with an alternative timetable agreed in writing by the Local Planning Authority. Once provided the drainage system shall be maintained in accordance with the maintenance scheme as approved under the provisions of condition 11 attached to planning permission ref. no. W/10/00295.

    Reason - To ensure the provision of an adequate and sustainable drainage system.

  9. The proposed development shall include the provision of affordable housing of a type, size and location in accordance with the Council's Supplementary Planning Guidance on the provision of affordable housing.

    Reason - To ensure the proposed development complies with the Council's policy and guidance on the provision of affordable housing.

  10. The reserved matters details required under conditions 1 and 2 above shall include details of on-site play and recreation space/facilities in accordance with the details set out in the land budget table set out on page 41 of the submitted Design and Access Statement. Details to be submitted shall include landscaping, planting and equipment to be provided on the proposed amenity spaces.

    Reason - To ensure the provision of adequate amenity/open space and recreation facilities to serve the proposed development.

  11. Within one month of the date of this planning permission, details of phasing for the approved development shall be submitted to the Local Planning Authority for approval in writing. The phasing plan shall include details of:-

    - the timing of the provision of infrastructure to serve the proposed development (including road improvements and drainage facilities) in relation to the provision of any new residential units; - the timing of the provision of on-site recreation/open play space provision in relation to the provision of any new residential units.

    The development shall be carried out in accordance with the approved phasing plan.

    Reason - To ensure the proposed development is constructed in such a way to ensure that any new units provided are adequately served by infrastructure and recreation facilities.

  12. No building on any part of the development hereby permitted shall exceed 3 storeys in height.

    Reason - To ensure that the proposed development is appropriate in design terms and to protect the amenities of neighbouring properties.

  13. In relation to the requirements of conditions 1 and 2, details of the floor levels of all proposed buildings shall be submitted as part of any reserved matters application(s). Any buildings approved shall be constructed at approved floor levels.

    Reason - In the interests of amenity.

  14. Prior to the first occupation of any of the individual residential units hereby permitted, in-coming residents shall be provided with information packs setting out ways that people can avoid damage or disturbance to wildlife habitats. The information packs shall include advice on measures that can be employed to reduce the risk of cat predation.

    Reason - To assist with the protection and enhancement of the biodiversity value of the site (and as suggested in para 5.5.4 and 5.5.9 of the submitted Ecological Assessment Report).

  15. Prior to the occupation of any of the dwellings hereby permitted, details of a lighting scheme to serve the proposed development shall be submitted to the Local Planning authority for approval in writing. The lighting scheme shall be designed to reduce effects upon sensitive habitats to be retained/created on the site. The details shall include an implementation timetable and the approved lighting scheme shall be provided in accordance with the approved implementation timetable.

    Reason - To ensure that any lighting scheme to serve the proposed development does not unnecessarily and adversely affect the bio-diversity value of the site.

  16. All drainage serving highways to provided as part of the proposed development shall be provided with trapped gullies.

    Reason - To prevent contaminant from entering the watercourse and to protect the biodiversity of the site.

  17. Any balancing ponds to be provided on the site shall be constructed and landscaped in accordance with details submitted and approved persuant to condition 21 attached to planning permission ref. no. W/10/00295.

    Reason - To ensure the proposed sustainable drainage system is designed to promote the biodiversity value of the site and the ponds are of sufficient design and capacity to deal with surface water run-off from the site.

  18. The development and associated site clearance shall be carried out in accordance with the methodologies set out in para 5.4.12 and 5.4.13 of the Ecological Assessment Report submitted with planning application ref. no. W/10/00295 so as to protected breeding birds and reptiles.

    Reason - To avoid unnecessary harm being caused to the biodiversity value of the site.

  19. Prior to the occupation of any of the units hereby permitted details of the design and location of bird boxes to be provided as part of the proposed development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include an implementation timetable and the approved bird boxes shall be provided in accordance with the approved timetable.

    Reason - To ensure the proposed development includes measures to enhance the biodiversity of the site.

  20. The development shall be carried out in accordance with the approved method statement to reduce disturbance to nearby badger setts approved under the provisions of condition 24 attached to planning permission ref. no. W/10/00295.

    Reason - To ensure the proposed development causes no harm to protected species.

  21. Prior to occupation of any of the dwellings hereby approved, a detailed management plan for the management of wildlife habitats to be provided on the site shall be submitted to the Local Planning Authority for approval in writing. The management plan shall include measures to secure the long term bio-diversity value of the application site and a timetable for implementation. The management plan shall be adhered to whilst any of the residential units hereby approved are occupied.

    Reason - To protect the biodiversity value of the site.

  22. Any works to be carried out to the pedestrian bridge across the watercourse on the site shall be in accordance with the details approved under the provisions of condition 26 attached to planning permission ref. no. W/10/00295 .

    Reason - To ensure the proposed development includes appropriate linkages across the site and ensure any works to the bridge do not exacerbate flood risk.

  23. The development shall be carried out in accordance with the Site Waste Management Plan submitted to and approved under the provisions of condition 28 attached to planning permission ref. no. W/10/00295.

    Reason - To protect environmental assets and ensure the development is carried out without unnecessarily waste of resources.

  24. The noise mitigation schemes approved under the provisions of conditions 30 and 31 attached to planning permission ref. no. W/10/00295 shall be implemented in accordance with the implementation timetable also approved under the provisions of condition 30 and 31. Once implemented the scheme of measures shall be maintained accordance with the approved details.

    Reason - To ensure the proposed development is not subject to unacceptable levels of noise disturbance.

  25. The existing dwellinghouse on the site Southbank which is identified as accommodating bat roosts within the submitted Ecological Report shall be retained and not demolished. The developmment shall be carried out in accordance with the measures to protect bats and bat roosts as required and approved under the provisions of condition 34 attached to planning permission ref. no. W/10/00295.

    Reason: To prevent harm or risk of harm to protected species.

  26. Piling or any other foundation designs using penetrative methods shall not be permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to groundwater. The development shall be carried out in accordance with the approved details.

    Reason - To ensure that the development complies with approved details in the interests of protection of Controlled Waters.

  27. No more than 75 dwellings hereby approved shall be occupied until:-

    - details of the roundabout to facilitate access from Offenham Road to serve the residential development as indicated in principle drawing number 9091-16 revision C (submitted with planning application ref. no. W/10/00295) and the provision of a footway link to Lichfield Ave have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority; and - the roundabout scheme has been constructed and completed in accordance with the approved details.

    Prior to the completion of the roundabout on Offenham Road, non-construction vehicular access to the development shall be via the temporary access shown on drawings numbered:-

    - 0091-2_101 - 091-0-302 - 091-0-303 rev B, and - 091-0-304 rev B

    Reason - To ensure the safe and free flow of traffic on the highway.

  28. No more than 150 dwellings hereby approved shall be occupied until:-

    - details of the junction alterations Elm Road- Offenham Road in accordance with drawing number 9091-12 Revision C (submitted with planning application ref. no. W/10/00295) have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority; and - the junction alterations have been constructed and completed in accordance with the approved details.

    Reason - To ensure the safe and free flow of traffic on the highway.

  29. No more than 75 dwellings hereby approved shall be occupied until:-

    - engineering details to the Kings Road alignment alterations in accordance with drawing 9091-14 Revision G (submitted with planning application ref. no. W/10/00295) have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority; and - the road alterations have been constructed and completed in accordance with the approved details.

    Reason - To ensure the safe and free flow of traffic on the highway.

  30. None of the individual dwellings hereby approved shall be occupied until the road works necessary to provide access from the publicly maintained highway (Offenham Road) have been completed in accordance with the details submitted to and approved in writing by the Local Planning Authority.

    Reason - To ensure an adequate and acceptable means of vehicle and pedestrian access is available before the dwellings are occupied

  31. Each individual dwelling hereby permitted shall not be occupied until the individual vehicular accesses, entrance, turning areas and driveways/parking spaces to serve that dwelling have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.

    Reason - In the interests of highway safety.

  32. Means of vehicular access for site operatives and construction traffic to the development hereby approved shall be from Offenham Road only.

    Reason - In the interests of highway safety.

  33. Means of vehicular access for all vehicles other than buses, refuse vehicles and emergency vehicles to the proposed residential development hereby approved shall be from Offenham Road only. Details of measures, including an implementation timetable, to prevent general vehicular movement to and from the site directly from Kings Road shall be submitted to the Local Planning Authority for approval in writing within three months of the date of this permission. The approved measures shall be provided in accordance with the approved implementation timetable.

    Reason - In the interests of highway safety.

  34. Prior to the first occupation of any dwelling hereby approved secure parking for cycles to comply with the Council's standards shall be provided within the curtilage of each dwelling and or grouped parking serving apartments, flats and these facilities shall thereafter be retained for the parking of cycles only.

    Reason - To comply with the Council's parking standards.

  35. No development shall take place which obstructs the existing public right of way crossing the application site.

    Reason - To ensure the public right of way is not obstructed.

  36. The approved Travel Plan (dated 14th September 2010 SKP/AVS/9091-06 rev D and submitted with the planning application ref. no. W/10/00295) shall be monitored in accordance with details set out in the plan and the results of the monitoring shall be submitted to the Local Planning Authority within one month of the end of each monitoring period. Where targets are not achieved, the Travel Plan shall be reviewed and updated and submitted to the Local Planning Authority for approval. The updated Travel Plan shall be implemented within one month of the date of the Local Planning Authority's approval.

    Reason - To enable the A46 to continue to be an effective part of the national system of routes for through traffic, in accordance with Section 10(2) of the Highways Act 1980 and in the interests of promoting sustainable development.
