This decision is subject to the following conditions:
By reason of its positioning to the east of the established line of development along Cleeve Road, as well as the encroachment into the open aspect and landscape of the scheduled ancient monument and Grade I listed Tithe Barn as well as the adjacent grouping of highly graded heritage assets, the proposed development will harm the setting of historic assets of the highest significance.
The open aspect and landscape has remained as such since the erection of the Tithe Barn in the 13th century and forms the historical setting of these heritage assets and the village layout.
The proposal would fail to protect or enhance this historic environment and by reason of the heritage assets being recognised as of the high significance, it is not considered that the public benefits of providing new housing and built form in this location outweighs the harm to these assets.
Therefore, the development fails to fully accord with Wychavon District Local Plan policy ENV14 (Setting of Listed Buildings) as well as para. 7 of the National Planning Policy Framework with regards to the environmental role of sustainable development. The proposal also fails to comply with paras. 129, 132 and/or 133 of the NPPF. The proposal is therefore not considered to represent sustainable development.
Whilst noting the applicant's willingness to enter into a legal agreement, no secure arrangements are in place to secure:
- the provision of affordable housing as part of the proposed scheme; and
- the provision of a contribution towards the enhancement of off-site cycling facilities; and measures to promote non-car travel to and from the site as set out in the submitted Travel Plan, including provision/funding of a new bus service.
- the provision of a contribution to enhance the provision of off-site public open space facilities;
As such, the proposed development does not meet the objectives of sustainable development and cannot be accommodated with acceptable impacts on community and the environment and is is contrary to policies GD3, SR5, COM2 and COM12 of the Wychavon District Local Plan 2006 and the provisions of the Council's Supplementary Planning Guidance on Developer Contributions, Affordable Housing SPG as well as the provisions of the National Planning Policy Framework.
