This decision is subject to the following conditions:
For a period of 5 years from the date of this permission, the seasonal workers caravans and recreation room shall only be positioned on site as set out on the approved drawing no. 101D. After this five year period the caravans and recreation room shall be removed from their approved position (as shown on drawing no. 101D) and stored in the area as set out on the on drawing No. SK100B between the period of November 1st to March 31st of each year.
Reason: The caravans and recreation room are needed for seasonal workers and they would not be required outside of the seasonal period to meet the needs of Sandfields Farm Ltd. This temporary permission will enable the monitoring and assessment of the landscape scheme to ensure that the caravans and recreation room preserve the character and appearance of the surrounding rural landscape. This is in accordance with Local Plan policy ENV1.
Within 6 months of the date of this permission the caravans shall be stained in a colour (dark green) matching that of the approved recreation room. The colour of both the caravans and recreation room shall be retained thereafter.
Reason - To ensure that the development is visually satisfactory. This is in accordance with Local Plan Policy SUR1 and ENV1. .
The 35 caravans and recreation room hereby approved shall only be used by seasonal packhouse workers employed by Sandfields Farm Ltd.
Reason - The permission was granted on the supporting evidence advanced by the applicants with regards to the economic development argument and the applicants entering into a legal agreement to restrict the use of the caravans and the produce handled in by the seasonal workers in the packhouse. This is in accordance with the provisions of the NPPF.
The caravans and recreation room shall not be occupied between the periods of November 1st to March 31st each year.
Reason - The caravans and recreation room are needed for seasonal workers and they would not be required outside of the seasonal period to meet the needs of Sandfields Farm Ltd. The permanent occupation of the caravans would not be accord with saved Local Plan Policy GD1 and the provisions of the NPPF.
The development hereby permitted shall be carried out in accordance with the details agreed by Severn Trent Water, which were formally discharged on 22/03/13.
Reason - To reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution.
The development permitted shall accord with the details set out in the submitted Water Management Statement (with the exception of details on foul drainage, which is subject to a separate condition) shall be fully implemented and remain thereafter. Reason - To ensure that an appropriate sustainable drainage system is provided to serve the development and to reduce the consumption of water. This is in accordance with the SPD on Water Management.
Where a satisfactory landscape scheme has been submitted as part of the application (Additional Landscape Scheme Job No. 447 Drg. No. 01).
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the completion or first occupation/use of the development, whichever is the sooner.
All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.
Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless otherwise agreed in writing by the Local Planning Authority.
Reason - To protect and enhance the visual amenities of the area and to ensure the satisfactory development of the site - in accordance with Policy GD2 and ENV1 of the Wychavon District Local Plan (June 2006).
All existing trees and hedges on site, or branches from trees on adjacent land that overhang the site, unless indicated on the approved plan(s) to be removed, shall be retained and shall not be felled or pruned or otherwise removed within a period of five years from the completion of the development without the previous written consent of the Local Planning Authority.
Temporary fencing for the protection of all retained trees/hedges on site during development shall be erected, to a minimum height of 1.2 metres, below the outermost limit of the branch spread, or at a distance equal to half the height of the tree, whichever is the further from the tree.
Such fencing should be erected in accordance with BS 5837:2005, before any materials or machinery are brought onto site and before any demolition or development, including erection of site huts, is commenced.
This protective fencing shall be maintained on site until the completion of development, and nothing should be stored or placed, nor shall any ground levels be altered, within the fenced area without the previous written consent of the Local Planning Authority.
There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.
If any retained tree/hedge is removed, uprooted or destroyed or dies, replacement planting shall be carried out in the first available planting season of such species, sizes and numbers and in positions on site as may be specified by the Local Planning Authority.
Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with Policy ENV1 of the Wychavon District Local Plan (June 2006).
The development shall adhere to the provisions of the Written Scheme of Investigation, which were formally discharged on 26/06/13.
Reason - To ensure that the historic environment is not harmed by the proposed development.
The risk assessment submitted and formally discharged on 01/05/13 shall be adhered to.
Reason - To ensure that the risks to buildings and their occupants from landfill sites is adequately addressed.
The development shall accord with the access, turning area and parking facilities shown on the approved plan. These areas shall thereafter be retained and kept available for those uses at all times.
Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
