Wychavon District Council, of The Civic Centre, Queen Elizabeth Drive, Pershore, Worcestershire WR10 1PT HEREBY CERTIFY that application reference registered on for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and on the plans attached to this Notice, as the matter described in the First Schedule to this Notice would not be lawful as at the within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :-
That the matter described in the First Schedule constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended) thus requiring planning permission. On the date of the application (16 December 2013) the terms of paragraph A.4 of Class A, Part 1 of Schedule 2 of the General Permitted Development Order 1995 (as amended by statutory instrument 2013 no. 1101) have not not been complied with. Therefore on the date of the application, the proposed development does on constitute permited development under the terms of any general development order and is therefore unlawful.
