This decision is subject to the following conditions:
Planning decisions should avoid noise from giving rise to significant adverse impacts and mitigate and reduce to a minimum other adverse impacts on health. It is considered that the applicant has failed to demonstrate that the future occupiers of the site would not have their amenities, health and well-being adversely impacted upon by the adjoining railway line and Wienerberger brickworks site. The failure to fully consider the impacts of vibration from the railway line and noise and smell nuisance from the brickworks site raises significant shortcomings in the proposal. Therefore, the proposal fails to accord with Saved Local Plan (2006) Policy GD2 as well as guidance contained in the National Planning Policy Framework (in particular Chapter 11) as well as guidance contained in the National Planning Practice Guidance.
Whilst noting the applicant's willingness to enter into a legal agreement, no secure arrangements are in place to ensure the provision of affordable housing or of the contributions to be made towards the enhancement/provision of education facilities within the area, off site built sport / leisure facility provision; the provision and maintenance of public open space, recycling; cycling and highway infrastructure. As such, the application is contrary to saved Policies GD3, SR5, COM2 and COM12 of the Wychavon District Local Plan (June 2006), the provisions of the Council's Supplementary Planning Guidance on Affordable Housing (2002), the provisions of the Council's Supplementary Planning Document on Education Contributions (April 2007) and the provisions of the Council's Supplementary Planning Guidance Note on Developer Contributions Towards Service Infrastructure as well as guidance contained in the National Planning Practice Guidance (2014).
