This decision is subject to the following conditions:

  1. The development hereby permitted shall be begun before the expiration of three years from 17 September 2013 (the date of permission ref. no. W/13/01345/PN).

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

  2. Prior to the commencement of development hereby approved, details of a 1 metre high acoustic barrier to be erected above the 1.8 metre brick boundary wall along the northern boundary between units 3 & 4 and 7 & 8 shall be submitted to and approved by the local planning authority. The approved fencing shall be erected in accordance with the approved details prior to any of the units being first occupied/used and the fencing shall remain in place for perpetuity.

    Reason - To safeguard the amenities of the occupiers.

  3. The development hereby permitted shall be carried out in accordance with the following approved plans: 2010.48 04, 2010.48 03C, 2010.48 02, 2010.48 01, 2010.48 05

    Reason - To define the permission.

  4. The materials shown on the plans approved under permission ref. no. W/14/00142 shall be used and no others substituted without the approval, in writing, of the Local Planning Authority before work on the site commences.

    Reason - To ensure that the development is visually satisfactory.

  5. In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11' and where remediation is necessary a remediation scheme must be prepared and approved in writing by the Local Planning Authority in advance of the scheme commencing.

    Following completion of measures identified in the approved remediation scheme a verification report must be prepared which shall be submitted to and approved in writing by the Local Planning Authority prior to development commencing other than works required to be carried out as part of an approved scheme of remediation.

    Reason - To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other off-site receptors.

  6. The development hereby permitted shall not be brought into use until the vehicular access and entrance, turning areas and demarcated parking spaces shown on the plans approved under permission ref. no. W/13/01345/PN have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.

    Reason - In the interests of vehicle and pedestrian safety.

  7. Development shall not begin until parking for site operatives and visitors has been provided in accordance with details to be submitted to and approved in writing by the Local Planning Authority and such provision shall be retained and kept available during construction of the development.

    Reason - To prevent indiscriminate parking.

  8. No part of the development shall be commenced until full details of soft landscaping works have been submitted to and approved in writing by the Local Planning Authority. The details submitted must include:

    i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.

    All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.

    Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless otherwise agreed in writing by the Local Planning Authority.

    Reason - To protect and enhance the visual amenities of the area and to ensure the satisfactory development of the site in accordance with Policies GD2 and ENV1 of the Wychavon District Local Plan (June 2006).

  9. Before the development hereby approved is first commenced details of the means of screening the refuse areas shall be submitted to and approved in writing by the Local Planning Authority . The means of screening so approved shall be implemented and retained thereafter unless agreed otherwise in writing by the Local Planning Authority.

    Reason - To ensure that this part of the development is visually satisfactory.

  10. Before the development hereby approved is commenced a construction environmental management plan (CEMP) shall be submitted for the approval of the Local Planning Authority. The CEMP shall include specific noise level targets and vibration levels at residential properties, hours of operation for construction, methods of piling (if appropriate) and type of machinery to be used to meet the noise and vibration levels of the CEMP and dust control measures. In producing the CEMP guidance should be sought from BS 5228 as well as the guidance from Worcester Regulatory Services at Worcestershire County Council.

    Reason - To preserve the amenities of the locality.

  11. Development shall not begin until drainage works have been carried out in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

    Reason - To ensure a satisfactory means of drainage is available to serve the development.

  12. The brick wall along the western and northern site boundaries shall be retained at a height of 1.8m unless agreed otherwise in writing by the Local Planning Authority.

    Reason - To preserve the amenities of the locality.

  13. Details of any external lighting of the site shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. This information shall include a layout plan with beam orientation and a schedule of equipment in the design (luminaire type, mounting height, aiming angles and luminaire profiles). The lighting shall be installed, maintained and operated in accordance with the approved details unless agreed otherwise in writing by the Local Planning Authority.

    Reason - To ensure the development is visually satisfactory and to protect local residents from light pollution.

  14. Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 0800 and 1800 Monday to Friday and 0800 and 1300 hours on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on a Sunday or Bank Holiday.

    Reason - To preserve the amenities of the locality.

  15. Before the development hereby approved is commenced details of sound attenuation measures to be incorporated within each of the units shall be submitted to and approved in writing by the Local Planning Authority. The approved measures shall be incorporated within the completed units before they are first occupied and retained thereafter unless agreed otherwise in writing by the Local Planning Authority.

    Reason - To preserve the amenities of the locality.

  16. The units hereby approved shall only be used during the hours 0700 hours to 2000 hours Monday to Friday, 0800 hours to 1700 hours on a Saturday and 0900 hours to 1300 hours on a Sunday.
