This decision is subject to the following conditions:
Paragraph 23 of the Planning Policy for Traveller Sites states that gypsy sites in rural areas should respect the scale of, and should not dominate the nearest settled community. It is reasonably considered in this circumstance that the 10 residential properties and Travelodge premises located in a cluster pre-dominantly to the north of the application site, located to the east of the A449 highway, would represent the nearest settled community. The proposal would result in a total of 35 pitches, which amounts to a ratio of approximately 3 gypsy pitches to every 1 existing local property/premise. It is considered that in this case, the adverse impacts of granting permission would significantly and demonstrably outweigh the benefits. In light of this, the proposal is considered to dominate the nearest settled community, contrary to paragraph 23 of the Planning Policy for Traveller Sites, and paragraph 14 of the National Planning Policy Framework.
The Planning Practice Guidance (PPG) states that 'Adequate water and wastewater infrastructure is needed to support sustainable development'. The PPG also details that 'If there are concerns arising from a planning application about the capacity of wastewater infrastructure, applicants will be asked to provide information about how the proposed development will be drained and wastewater dealt with'. In this case, the applicants have failed to provide adequate information to demonstrate the sufficiency and capacity of the existing private wastewater system to support the new permanent and transit gypsy and traveller site of this scale. Without sufficient information the local planning authority do not therefore consider that the proposal represents sustainable development. The proposal therefore fails to comply with Saved local plan (2006) Policy GD2 as well as guidance contained in paragraph 109 of the National Planning Policy Framework (2013) and the PPG (2014).
