This decision is subject to the following conditions:
The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
No building hereby permitted shall be occupied until surface water drainage works have been implemented in accordance with details that have been submitted to and approved in writing by the local planning authority. Before these details are submitted an assessment shall be carried out of the potential for disposing of surface water by means of a sustainable drainage system in accordance with the principles set out in Annex F of PPS25 (or any subsequent version), and the results of the assessment provided to the local planning authority. Where a sustainable drainage scheme is to be provided, the submitted details shall: provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; include a timetable for its implementation; and provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime. Reason - To ensure the proposed development is served by an appropriate surface water drainage system.
None of the development hereby permitted shall be occupied until works for the disposal of foul sewage have been provided on the site to serve the development hereby permitted, in accordance with details to be submitted to and approved in writing by the Local Planning Authority.
Reason - To ensure a satisfactory means of drainage is available to serve the development.
The development hereby permitted shall only be occupied by
(i) persons who at the date of taking up residence shall be over 60 years of age, frail, in need of care and support or any spouse, cohabitee or dependent living with any such person for duration of that person's or the dependent's life; or (ii) any registered disabled person and any spouse, cohabitee or dependent living with any such person for duration of that person's or the dependent's life; or (iii) any person in need of and currently receiving care and support and any spouse, cohabitee or dependent living with any such person for duration of that person's or the dependent's life; or (iv) any person employed or engaged to provide services for any persons living on the site falling within any of the categories i to iii above.
Reason - As the development proposal is only deemed acceptable against planning policies because it is proposed to provide accommodation for elderly persons for which there is a significant need.
The development hereby permitted shall not be brought into use until the applicant has submitted to and have approved in writing a staff and residential Travel Plans that promotes sustainable forms of access to the site with the Local Planning Authority. This plan thereafter will be implemented and updated in agreement with Worcestershire County Councils Travel plan co-ordinator.
Reason - To reduce vehicle movements and promote sustainable means of transport.
Notwithstanding the details provided with the planning application and prior to the commencement of development hereby approved the following details shall be submitted to the local planning authority for approval in writing:-
- details on how renewable energy measures are to be incorporated into the proposed development; - details of energy efficiency measures to be incorporated into the proposed development; and - details of construction materials to be used in the proposed development with the aim of minimising the use of primary non-sustainable materials.
The approved measures shall be implemented and incorporated into the approved development in line with a implementation timetable to be submitted and approved in writing by the local planning authority prior to the commencement of development.
Reason - To ensure the prudent use of natural resources.
Prior to the commencement of development full details of measures to safeguard protected species and to enhance the biodiversity of the site shall be submitted to the local planning authority for approval in writing. Details to be submitted shall include:-
- measures to protect bats and roosts within the existing trees on the site during construction; - position and design of new bat boxes to provided on the site; - measures to be employed to avoid harm to bats during the demolition of existing buildings; - position and design of roosts to be provided within any of the proposed buildings; - a timetable for implementation of the various proposed measures.
The development shall be carried out fully in compliance with the approved measures and implementation timetable.
Reason - To ensure that the proposed development does not harm protected species and enhances the biodiversity value of the site.
Prior to the commencement of development a scheme for the external lighting of the site shall be submitted to the local planning authority for approval in writing. No external lighting other than that approved as part of this scheme shall be provided on the site.
Reason - In the interests of visual amenity and to ensure that the proposed external lighting does not have an adverse impact on the well-being of protected species.
All planting and seeding/turfing comprised in the submitted landscape master plans and planting plan (1002 L 18 Rev B ), hereby approved, shall be carried out in the first planting season following the completion or first occupation/use of the development, whichever is the sooner.
All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.
Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless otherwise agreed in writing by the Local Planning Authority.
Reason - To protect and enhance the visual amenities of the area and to ensure the satisfactory development of the site - in accordance with Policy GD2, Policy ENV1 and Policy SUR2 of the Wychavon District Local Plan (June 2006).
The development hereby permitted shall not be brought into use until the vehicular accesses and entrances, turning areas internal roadways and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.
Reason - In the interests of internal vehicle and pedestrian safety.
The development hereby permitted shall not begin until a Construction Method Statement has been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The approved statement shall be adhered to throughout the construction period. The statement shall set out and relate to the following issues:-
a) The parking of vehicles of site operatives and visitors within the application site. b) Loading and unloading of plant and materials within the application site. c) Storage of plant and materials within the application site. d) Siting of site offices within the application site. e) routing of construction traffic onto and off the site f) measures to minimise and control noise, vibration and dust disturbance from the site during construction (including hours of construction and delivery times) g) artificial lighting h) details of the timing and method of any piling and boring work to be carried out on the site.
Reason - To prevent indiscriminate parking in the interests of highway safety and to ensure the proposed construction works do not unduly harm the amenities of nearby properties.
No dwelling hereby permitted shall be occupied until the applicant has submitted to and have approved in writing a welcome pack that promotes sustainable travel for future residents with the Local Planning Authority.
Reason - To reduce vehicle movements and promote sustainable access.

Reason - To define the permission.
No development shall take place until samples of the materials to be used in the construction of the external surfaces of the buildings hereby permitted have been submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details.
Reason - Details shown on the drawings are not satisfactory and to ensure the proposed development appears in keeping with the area.
Prior to the commencement of development, details of scheme for the provision and implementation of a surface water regulation system that includes the use of Sustainable Drainage Systems shall be submitted to the Local Planning Authority for approval in writing. The Scheme should ensure no increase in run-off from the site for all flood events up to the 100 year storm event with allowances for climate change. The surface water drainage scheme should identify any possible overland flood flow routes that could occur, and ensure no properties are affected. A scheme for maintenance and adoption of the drainage system should also be provided for approval in writing.
A surface water drainage scheme shall be implemented in accordance with approved details prior to the occupation of the development hereby approved or in accordance with an alternative timetable agreed in writing by the Local Planning Authority. Once provided the drainage system shall be maintained in accordance with the approved maintenance scheme.
Reason - To ensure the provision of an adequate and sustainable drainage system.
Prior to the first occupation of the apartments hereby approved secure parking for 2 cycles to comply with the Council's standards shall be provided for of each category C3 dwelling and these facilities shall thereafter be retained for the parking of cycles only.
Reason - To comply with the Council's parking standards.
Prior to the first occupation of the care units herby approved secure and dry staff parking for 20 cycles to comply with the Council's standards shall be provided within the curtilage of site and these facilities shall thereafter be retained for the parking of cycles only.
Reason - To comply with the Council's parking standards.
Development shall not begin until wheel-cleaning apparatus has been provided in accordance with details to be submitted to and approved in writing by the Local Planning Authority and this equipment shall be operated and maintained during construction of the development hereby approved.
Reason - To ensure that the wheels of vehicles are cleaned before entering and leaving the principal road A44 in the interests of highway safety.
Drainage arrangements shall be provided to ensure that surface water from the main entrance and southern entrance to A44 together with the internal roads does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.
Reason - In the interests of highway safety.
Before any other works hereby approved are commenced, visibility splays shall be provided from a point 0.6m above ground level at the centre of the access to the application site and 2.4 metres back from the nearside edge of the adjoining carriageway A44 (measured perpendicularly), for a distance of 90 metres in a northerly direction and 90m in a southerly direction measured along the nearside edge of the adjoining carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above and these areas shall thereafter be retained and kept available for visibility purposes at all times.
Reason - In the interests of highway safety.
Upon completion and occupation of 75% of the units hereby approved, the existing southern vehicular access arrangements onto the adjoining highway, A44 shall be closed. Details of the means of secure closure, which shall include the restored "Golden Gates", of this existing set back gated entrance shall be submitted to and approved in writing by the Local Planning Authority and the scheme shall subsequently be implemented in accordance with the approved details.
Reason - To ensure the safe and free flow of traffic using the adjoining County highway.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.30 and 17.00hrs Monday to Friday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Saturdays, Sundays or Bank Holidays.
Reason - To preserve the amenities of the locality.
