This decision is subject to the following conditions:

  1. Whilst noting the applicant's willingness to enter into a legal agreement, no secure arrangements are in place to ensure:

    - the provision of a contribution to be made towards off-site public open space, built leisure and sport facilities that will be made available for public use. As such, the application is contrary to saved Policies GD3 and COM12 of the Wychavon District Local Plan 2006 and the provisions of the Council's Supplementary Planning Guidance to Public Open Space.

    - the provision of a contribution to be made towards the enhancement/provision of off-site measures to encourage recycling. As such, the application is contrary to saved Policy GD3 of the Wychavon District Local Plan 2006 and the provisions of the Council's Supplementary Planning Guidance Note on Developer Contributions Towards Service Infrastructure.

    - the provision of a contribution to be made towards the enhancement/provision of off-site measures to encourage travel to and from the site by means other than private car. As such, the application is contrary to saved Policies GD3 and SR5 of the Wychavon District Local Plan 2006 and the provisions of the Council's Supplementary Planning Guidance Note on Developer Contributions Towards Service Infrastructure.

  2. Notwithstanding the above reason, the applicants have shown unwillingness to accept the Council's request for affordable housing contributions in relation to this development, in accordance with Local Plan saved Policy COM2, GD3 and the council's Affordable Housing Supplementary Planning Statement. In accordance with Local Plan saved Policy ECON20 paragraph 6.8.8 permanent residential caravan sites should be assessed under the same criteria for housing development. The proposed residential site lies outside any defined development boundary as indicated within the Wychavon District Local Plan, where it is the policy of the local planning authority to resist further residential development.

    In the absence of contributions towards affordable housing, the council considers that although a small contribution to the council's 5 years housing land supply, the application would not adequately provide for the necessary infrastructure proportionate to the development being proposed. Seeking such contributions is considered crucial in achieving the objectives of the Plan as this would contribute to the community's need for affordable housing, which is a material planning consideration in the assessment of this proposal.
