This decision is subject to the following conditions:
The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following approved plans: '01'; '02'; '10'; '16'; '20 A'; '30'.
Reason - In order to define the permission.
Notwithstanding the information submitted, details of the form, colour and finish of the materials to be used externally on the walls and roofs shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.
Reason - To ensure that the development is visually satisfactory, in accordance with saved Policies GD2 and SUR1 of the Wychavon District Local Plan (June 2006)
Notwithstanding the information submitted, the development hereby approved shall not be occupied until drainage works for the disposal of both storm water and foul water have been carried out in accordance with details to be submitted to and approved in writing by the Local Planning Authority. Such details would need to reasonably demonstrate that ground conditions are suitable for the proposed drainage scheme, and existing drainage systems have sufficient capacity to accommodate the approved development.
Reason - To ensure a satisfactory means of drainage is available to serve the development, in accordance with saved Policies GD2 and ENV19 of the Wychavon District Local Plan (June 2006)
The development hereby permitted shall not be occupied until the access, turning area and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.
Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway, in accordance with saved Policy GD2 of the Wychavon District Local Plan (June 2006)
The development hereby permitted shall be carried out in accordance with the 'Recommendations' as specified in sections 6.1, 6.2, and 6.3 of the Phase 1 Environmental Survey undertaken by Greenscape Environmental Ltd dated November 2013. A suitable bat box and bird box shall be installed on site in accordance with the 'Recommendations' of the aforementioned survey, the details and positions of which shall be submitted to, and agreed in writing by, the local planning authority, prior to the commencement of the development hereby permitted.
Reason: To ensure protected species are not harmed by the development and an offence under the Conservation of Habitats and Species Regulations 2010 and the Wildlife and Countryside Act 1981(as amended) is avoided, and to provide appropriate habitat enhancement for protected species in accordance with paragraph 118 of the Framework.
The business floorspace of the live/work unit shall be finished ready for occupation before the residential floorspace is occupied and the residential use shall not precede commencement of the business use.
Reason - To ensure that the development is a genuine live/work scheme
The business floorspace of the live/work unit hereby approved shall not be used for any purpose other than for purposes within class B1 in the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and reenacting that Order with or without modification.
Reason - In order to define the permission, and to protect the amenities of the neighbouring residential properties, in accordance with saved Policy GD2 of the Wychavon District Local Plan (June 2006)
The residential floorspace of the live/work unit shall not be occupied other than by a person solely or mainly employed, or last employed in the business occupying the business floorspace of that unit, a widow or widower of such a person, or any resident dependants.
Reason - To ensure that the development is a genuine live/work scheme
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, nothing in Article 3 and Schedule 2 to that order shall operate so as to permit any development specified in Part 1, Class A, B and C of the said schedule and no such development shall be carried out at any time without an express grant of planning permission under Part III of the Town and Country Planning Act 1990.
Reason - In order that the Local Planning Authority can gain control over the development to ensure that the dwelling is not disproportionately enlarged negating the reason for approval of this live/work scheme.
