This decision is subject to the following conditions:

  1. The only source of natural light to the proposed ground floor studio flat would be from the two proposed ground floor windows in the rear elevation of the building. These windows would receive minimal natural light given the proximity and orientation of neighbouring properties, including the two residential units to the rear of the building that were approved as part previous applications W/12/00792/PN and W/12/02617/PN. These approved residential units to the rear of the main building, would be approximately 1m from one of the proposed windows to serve the studio flat, and due to the natural ground slope, would result in a significant overbearing and dominant position. The garden areas that serve these two approved residential units would, when in use, provide unobstructed views in to the only two windows that would serve the proposed studio flat. As such, it is not considered that the future occupiers of the proposed studio flat would receive reasonable levels of amenity in terms of natural light or privacy, contrary to saved Policy GD2 of the Wychavon District Local Plan (June 2006)

  2. In accordance with paragraph 031 of the PPG, the information provided in flood risk assessments (FRA) should be credible and fit for purpose. The FRA must demonstrate that the development, and its occupants, will be safe and that proposals will not increase flood risk elsewhere. In times of flood, the future occupiers of the studio flat at ground floor level will have no refuge from the flood water, nor will they be able to move any of their possessions to a safe area within the locality. It is not considered that the submitted information has satisfactorily demonstrated that the proposed development would be 'safe' from flooding for its lifetime, taking account of the vulnerability of its users, contrary to saved paragraph 102 of the National Planning Policy Framework, paragraph 031, reference ID 7-031-21040306 of the Planning Practice Guidance, and saved Policy ENV17 of the Wychavon District Local Plan (June 2006)
