This decision is subject to the following conditions:
Wychavon District Council, of The Civic Centre, Queen Elizabeth Drive, Pershore, Worcestershire WR10 1PT HEREBY CERTIFY that application reference W/14/01387/LUE registered on 10 July 2014 for a Certificate of Lawfulness Existing Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and outlined in red on the plan attached to this Notice, for the following reason :-
That the matter described in the First Schedule to this Notice constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended) thus requiring planning permission.
The evidence submitted fails to demonstrate that on the balance of probability that the caravan is a building and therefore as it is considered to be a moveable structure designed for habitation the 10 year rule must be applied. As such no evidence has been submitted to demonstrate this argument.
