This decision is subject to the following conditions:

  1. The construction of the agricultural dwelling hereby permitted shall be begun before the expiration of two years from the date of this permission.

    Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004, and to ensure that the dwelling is constructed on the holding at the time when the circumstances of the holding justify it, in accordance with Policy SWDP19 of the South Worcestershire Development Plan.

  2. The existing mobile home on the site shall cease to be occupied and shall be removed from the site upon first occupation of the new agricultural worker's dwelling hereby permitted, or before the expiry of 3 years from the date of this permission, which ever is the sooner.

    Reason - To ensure the removal of the 'temporary' mobile home in order to protect the openness of the Green Belt and limit the accommodation on the site, in accordance with Policies SWDP2 and SWDP19 of the South Worcestershire Development Plan.

  3. The occupation of the dwelling hereby permitted shall be limited to a person solely or mainly working, or last working, in the locality in agriculture or in forestry, or a widow or widower of such a person, and to any resident dependants.

    Reason - Permission would not be granted for the proposed development unconnected with the use of adjoining land for agricultural or similar purposes. This is in accordance with Policy SWDP19 of the South Worcestershire Development Plan.

  4. Details of the form, colour and finish of the materials to be used externally on the walls of the development hereby approved shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences.

    Reason - To ensure that the development is visually satisfactory, in accordance with Policy SWDP21 of the South Worcestershire Development Plan. These details are required prior to the commencement as it would be impractical or inappropriate to submit and/or approve these details following commencement of development.

  5. Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement, so far as they relate to surface water only, shall be fully implemented and remain thereafter. Reason - To ensure that an appropriate sustainable drainage system is provided to serve the development and to reduce the consumption of water. This is in accordance with Policy SWDP29 of the South Worcestershire Development Plan.

  6. Notwithstanding the information submitted, the permanent dwelling hereby permitted shall not be occupied until works for the disposal of sewage have been provided on the site to serve the development hereby permitted, in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

    Reason - To ensure a satisfactory means of drainage is available to serve the development, in accordance with Policy SWDP30 of the South Worcestershire Development Plan.

  7. Prior to the occupation of the permanent dwelling hereby permitted details of renewable or low carbon energy generating facilities to be incorporated as part of the permitted development shall be submitted to and approved in writing by the local planning authority. The details shall demonstrate that at least 10% of the predicted energy requirements of the development will be met through the use of renewable/low carbon energy generating facilities. The approved facilities shall be provided prior to the permanent dwelling hereby permitted being first occupied.

    Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy SWDP27 of the South Worcestershire Development Plan.

  8. Details of suitable biodiversity enhancement measures, to include the provision of bat and/or bird roosting/nesting features, shall be submitted to and approved in writing by the local planning authority. The approved details shall be installed prior to the permanent dwelling hereby permitted first being occupied.

    Reason - To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area, in accordance with Policy SWDP22 of the South Worcestershire Development Plan and paragraphs 109 and 118 of the National Planning Policy Framework

  9. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, nothing in Article 3 and Schedule 2 to that order shall operate so as to permit any development specified in Part 1, Class A, B, C, E of the said schedule and no such development shall be carried out at any time without an express grant of planning permission under Part III of the Town and Country Planning Act 1990.

    Reason - In order that the local planning authority can gain control over the development in order to restrict the size and scale of the dwelling, and to preserve the openness of the Green Belt, in accordance with Policies SWDP2 and SWDP19.
